			    &lt;p&gt;This matter is before the Court on Appellant/ Defendant Mary Boehm and Appellant/ Defendant Club Comanche, Inc.'s (collectively "Appellants") Emergency Motion for an Interlocutory Appeal to the Supreme Court and Motion for Stay. The Appellee/ Plaintiff, Florence McDonnell and Appellant/ Defendant Estate of Richard M. Boehm, have filed responses opposing the motions for interlocutory appeal and for stay. For the reasons stated below, the relief requested by Appellants Mary Boehm and Club Comanche, Inc, will be denied.&lt;/p&gt;

			    &lt;p&gt;This matter is before the court on Appellant's motion for costs dated August 14, 2007. This Court affirmed the judgment of the Superior Court in this matter by Memorandum Opinion dated October 18, 2007. The Virgin Islands Supreme Court Rules provide that " if a judgement is affirmed, reasonable costs shall be taxed against the appellant ..." V.I.S.CT. R. 30(a) (emphasis added). Appellant is not a prevailing party in this matter and, therefore, is not entitled to award for costs.&lt;/p&gt;
