Citation: 2026 VI 19Summary: Considering an appeal from a judgment and commitment of the Superior Court of the Virgin Islands memorializing a jury verdict finding the appellant guilty of aiding and abetting first-degree murder in violation of title 14, sections 921, 922(a)(1), and 1t(a) of the Virgin Islands Code, and the Superior Court’s underlying evidentiary rulings regarding: (i) a knife (People’s Exhibit 18) and testimony concerning the same; (ii) a DNA report (People’s Exhibit 48) and testimony concerning the same; and (iii) a redacted RLSH digital record (People’s Exhibit 29) and testimony concerning the same, the appellant’s claims of error are rejected. The People were only required to present evidence that the appellant engaged in any of the acts that are listed in the statute, and whether he was aided and abetted by another person has no bearing on his personal responsibility for the crimes. In this case, there was sufficient evidence for the jury to convict the appellant of first-degree murder under an aiding-and-abetting theory. The challenged evidentiary rulings are affirmed, as is the Superior Court’s order denying the appellant’s motion to dismiss the murder charges, and its judgment is affirmed.Attachment: Open Document or Opinion
