Citation: 2024 VI 29Summary: Considering an appeal from the Superior Court’s judgment and commitment in which the appellant contended that the Superior Court failed to conduct a full re-sentencing hearing upon remand from the prior appeal in this case, reported at 73 V.I. 500 (V.I. 2020), since the appellant was present and was given the opportunity to participate fully in the initial sentencing hearing, and his re-sentencing for the purpose of vacating the convictions of lesser-included offenses to comport with the holding in Titre v. People, 70 V.I. 797 (V.I. 2019) – technically, a reduction of sentence – was not a critical stage of the proceedings against him, a lack of a full hearing on remand did not frustrate the fairness of the proceedings.
